Use of photographs without the author’s permission in cases not specified above shall be deemed copyright infringement under Section 40 of Act. In compliance with Section 105a of the Act, anyone who uses an author’s work without authorization shall be deemed to have committed an offense and may be imposed a fine in administrative proceedings of up to CZK 150,000. An author whose rights secured by a copyright have been violated or whose rights are under threat of violation may seek to have his rights redressed through the general courts and demand in particular that the violation of his rights be remedied and that he receive satisfaction in moneys if any other form of satisfaction is deemed insufficient. In the event of copyright infringement, the photo database creator, i.e., Czech Tourism, is authorized, having concluded a license agreement with the author of such work, to address the unfavourable situation through the general courts, and upon doing so will, in compliance with Act No. 89/2012 Coll., the Civil Code, first and foremost demand compensation for damage incurred.
If you are interested in using photographs for commercial purposes (e.g., in a publication for sale), it is necessary to contact the author. Permission to use a work has to be granted by the author of the work.
